Online sale of “The More Project” brand products by the company THE MORE PROJECT.

The company THE MORE PROJECT (Trade name: the More Project), with a capital of €10,000, with registered office at 9 rue Leroy, 92150 SURESNES FRANCE, is registered in France on the Paris Trade and Companies Register (RCS) under n° 903 674 174, publisher of website www.themoreproject.co.

THE MORE PROJECT undertakes to make its best efforts to ensure users and customers can access the website at any time. The website www.panafrica-store.com is available 24 hours a day, 7 days a week, except in cases of force majeure such as technical, maintenance or telecommunication difficulties.

ARTICLE 1: TERMS OF USE

Any access and/or use of the www.themoreproject.co website implies compliance with and acceptance of all the provisions of these general terms and conditions. They therefore constitute a contract between THE MORE PROJECT and the User/Customer.

The General Terms and Conditions are filed on the www.themoreproject.co website (hereinafter “the website”). The customer can find them at any time.

Purchasing products on the website is reserved for natural persons, who are not acting in a professional business capacity. The website does not allow products to be purchased for resale.

Any order of a product offered on the website implies full and complete adherence by the User to these General Terms and Conditions.

References such as “we” or “our” within these T&Cs refer to THE MORE PROJECT, and any reference to “you” or “yours” refers to you as a user or website customer.

ARTICLE 2: PLACING AN ORDER

You can place an order on our website www.themoreproject.co 24 hours a day, 7 days a week.

The ordering process consists of three (3) successive steps.

Once you have chosen your products (size, model, quantity) and confirmed your basket, you must:

1.   Choose your delivery method.

2.   Choose your payment method.

3.    Accept the General Terms and Conditions by ticking the box provided for this purpose on the summary page of your order. Confirming the order implies definitive adherence to these T&Cs.

The payment will formalise the sales contract which links you to THE MORE PROJECT in a firm and definitive way.

You can view and change the items in your order by clicking on “My basket” at any time.

Once the order has been confirmed, you will automatically receive an order confirmation email, including a summary of the items ordered.

Once your order has been confirmed and provided that we have previously obtained authorisation to debit your account, PANAFRICA will proceed with dispatch.

ARTICLE 3: PRODUCT AVAILABILITY

Items which can be seen on the website are available while stocks last. In the event of a debit taken or payment being accepted on an order for an unavailable item, THE MORE PROJECT commits to offer a credit note or to reimburse the customer within 14 days.

THE MORE PROJECT commits to inform the customer by email that they have placed an order for an unavailable item.

The means available to you to withdraw an order are described in the “right to withdraw” article.

ARTICLE 4: PRODUCT INFORMATION 

THE MORE PROJECT endeavours to provide customers and users with information on product characteristics, in particular by means of “Product Description”.

Only the products appearing on the website on the day of the customer’s order are available for sale. The photos, graphics and visuals shown on the website www.themoreproject.co are intended to illustrate the products available for sale and are non-contractual. The customer can refer to the Product Description for the product characteristics.

ARTICLE 5: PRICE AND PAYMENT

The purchase prices are shown in Euros and include all taxes, excluding delivery costs and any taxes and duties for shipping outside France (see article 6 for delivery cost details).

The VAT rate is the one in force on the day of the order in France.

The prices applied are those shown on the website at the time of order confirmation. Prices may be modified at any time by the seller, without prior notice, and in particular in the event of changes in fiscal or economic data.

The items ordered must be paid for in Euros and online. Any bank charges incurred by the payment shall be borne by the customer.

The delivered goods remain the seller’s property until full payment is received. THE MORE PROJECT will not be obliged to deliver the Products ordered by the Customer if the price has not been paid in full beforehand.

Online payment is made by bank card or by using a PayPal payment account. You certify that you are the holder of the bank card or the PayPal account used to pay for your items.

A summary invoice of the order will be available as soon as the order is shipped in the “history” section.

ARTICLE 6: DELIVERY COSTS, TIMES AND COUNTRIES

6.1 Delivery in France and abroad:

We deliver worldwide.

6.2 Delivery methods – delivery costs – delivery times

We prepare and dispatch your package within 24 hours (excluding weekends and bank holidays). The customer will be informed by email as soon as their package is dispatched, and they will receive the order tracking number to be kept informed of when the package has been successfully delivered.

Products are delivered within a maximum of 30 days from the date of full payment. If this period is exceeded, the customer may request immediate cancellation of the sale by sending an email to theo@themoreproject.co and obtain a refund of the sums paid in connection with this sale.

If you order several products, we may have to send them to you in several packages.

Before placing your order, you will be informed about the expected delivery time with an indicative delivery date. Once you have placed your order, you will receive a confirmation email with the expected delivery time.

The products ordered will be delivered to the delivery address you indicated when placing your order. We cannot be held responsible for incorrect or incomplete addresses.

 

6.3 Customs duties for orders outside the European Union:

For customers residing outside the European Union and in the French overseas departments and territories, the prices invoiced will be exclusive of tax. These prices must be understood as “Delivery Duty Unpaid” (DDU), as THE MORE PROJECT is unable to provide customers with exact information on the total amount of fees related to customs duties and formalities and import taxes applicable in the country where delivery is requested. The payment of these costs, which may be necessary for the entry of the ordered products into the delivery territory shall be borne solely by the customer.

Refusal by the customer to pay the customs duties will not result in the cancellation of the order or it being refunded. Any transport and customs clearance costs paid by THE MORE PROJECT to recall the order shall be borne by the customer.

ARTICLE 7: PAYMENT AND SECURITY

Payment for purchases must be made using a bank card (Debit Card, Visa, Mastercard, American Express) or a PayPal account.

The order will be registered as soon as the payment is accepted by the banking service. You must enter the card type, the name on the card, the card number, the expiry date and security code located on the back in the spaces provided.

Your bank account will be debited as soon as the order is placed.

We do everything necessary to ensure the confidentiality and security of data transmitted online and on the www.themoreproject.co website.

ARTICLE 8: RIGHT OF WITHDRAWAL

In accordance with the legal provisions in force, you have 30 days from receiving your products to exercise your right of withdrawal from THE MORE PROJECT without having to justify your reasons or pay any penalty. The starting point of this period is the day of receipt of the order by the customer or by the third party designated by them. If the 30-day period expires on a Saturday, Sunday, bank holiday or non-working day, it is extended until the next working day.

To exercise your right of withdrawal, you must inform THE MORE PROJECT of your decision to withdraw by sending us, before the 30-day period expires, the withdrawal form to be completed with us by email.

Returns must be made in a single package in their original condition and complete (packaging, accessories, original labels, etc.) allowing the Product(s) to be resold in a like-new condition. Products returned incomplete, damaged, or soiled will not be accepted for return or refund. If the return or exchange is refused, the items will be returned to the customer.

ARTICLE 9: RETURN: REFUND OR EXCHANGE

9.1 Time limit

Irrespective of the above-mentioned withdrawal period, you have 30 clear days from the date of receipt of the order to return the item(s) that do not suit you, subject to the conditions set out below.

If we receive your returned items more than 31 working days after receipt of the ordered products, we reserve the right not to exchange or refund the products. The items will be returned to you.

 

9.2 Return conditions and procedure

All requests for returns must be made within 30 days of receipt of the order, by email by following the following procedure:

1.   Share the order/product ID with us

2.   Letting us know the reason for return AND indicate whether you want an exchange or refund.

3.   Generate and print the return request PDF then attach it to the inside of your return package.

For customers with delivery addresses in mainland France and who haven’t bought items in promotional periods, a return slip will be sent to you by email within 3 days (excluding weekends and bank holidays) to be stuck to your return package.

 

9.3 Product condition

Returns must be made in a single package in their original condition and complete (packaging, accessories, original labels, etc.) allowing the Product(s) to be resold in a like-new condition.

The package must contain:

·         The products in perfect condition with their original label

·         The original product’s box

·         Any additional accessories

Products returned incomplete, damaged, or soiled will not be accepted for return or refund. If the return or exchange is refused, the items will be returned to the customer.

 

9.4 Return shipping costs

For mainland France, return shipping costs are free (excluding promotional periods, sales and the Christmas period) via Mondial Relay

For other countries, return shipping costs shall be borne by the customer.

 

9.5 Refunds of returns

When the right of withdrawal is exercised, and if the above-mentioned conditions are met, THE MORE PROJECT will refund you for the price of the product(s) purchased (excluding shipping costs if paid at the time of the order) at the latest within thirty (30) days from the date on which THE MORE PROJECT is informed of your decision to withdraw.

THE MORE PROJECT may defer the refund until receipt of the Products or until you provide proof of shipment of these goods.

The refund will be made by THE MORE PROJECT using the same payment method you used for the original transaction.

Only the cost (including all taxes) of the purchased products will be refunded (shipping costs will not be refunded).

ARTICLE 10: LEGAL GUARANTEES

All our products are covered by the legal guarantee, provided that they have been used normally and that the maintenance instructions have been followed. If there are defects in the goods you have purchased, THE MORE PROJECT complies with all legal regulations in terms of guarantee.

The products are covered by the legal guarantee of conformity (article L 211-4 et seq. of the French Consumer Code) and the guarantee against hidden defects (article 1641 et seq. of the Civil Code). Any guarantee is excluded in the event of external damage or damage resulting from misuse, improper use, negligence or lack of maintenance by the Customer, as well as in the event of normal wear and tear of the product.

The information you pass on when ordering is for THE MORE PROJECT and is used to process and track your orders, the after-sales service of the products ordered on our website and marketing management (newsletters, email campaigns etc.) and customer relationship management of your customer account.

Your personal data may be transmitted to THE MORE PROJECT’s service providers for the purpose of processing orders and after-sales service as well as for the purpose of marketing and customer relationship management, it being specified that some of these service providers are located outside the European Union.

You have the right to access, oppose, rectify and delete your personal data held by THE MORE PROJECT at any time, by writing by email or by post to the above addresses.

ARTICLE 12: RESPONSIBILITY

THE MORE PROJECT is fully responsible to the customer for the proper execution of the contract entered into with the customer.

However, THE MORE PROJECT cannot be held responsible for the non-execution or the improper execution of the contract entered into in case of force majeure, the occurrence of an event attributable to the customer or any unforeseeable and insurmountable inconvenience or damage inherent to the use of the internet network, notably a break in service, an external intrusion or the presence of computer viruses.

The THE MORE PROJECT website contains hypertext links which may redirect to other websites. THE MORE PROJECT cannot be held responsible for the content of these websites if they break the legal and regulatory provisions in force.

The photos and illustrations accompanying the products on our website have no contractual value and therefore THE MORE PROJECT cannot be held responsible for them.

ARTICLE 13: INTELLECTUAL PROPERTY RIGHTS

All elements of the website are the exclusive intellectual property of THE MORE PROJECT.

Using the website doesn’t authorise you in any way to exploit or reproduce designs. You do not have any copyright, trademark or other intellectual property rights.

The trademarks and distinctive signs of the Products on the Website are protected under trademark law; the reproduction or representation of any element is strictly prohibited.

The Website which is made available to you is intended solely for your personal and private, non-commercial use. The contents of the Website may not be used for any other purpose whatsoever without our express written consent.

ARTICLE 14: APPLICABLE LAW - DISPUTES

These general terms and conditions are subject to French law. In the event of persistent disagreement on the application, interpretation and execution of these terms and conditions, and in the absence of an amicable agreement, any dispute will be referred to the competent French courts.
